OUR SERVICES

Entering China — or has someone already filed your brand?

China’s system weighs first-to-file heavily. We map protectable elements and classes, watch close filings, organise opposition or invalidation materials, and help with platform takedown notices. Results depend on evidence and examination — no guarantees.

Brand review documents and a protective shield motif (display illustration placeholder)

Holding marks only in the US or Europe does not give you a China registration. Someone else can still file first before you manufacture or sell into China.

If a search shows your English name or Chinese transliteration filed by an unrelated party, opposition windows are short — assess opposition or later invalidation promptly.

We search, map classes, file, prepare opposition/invalidation papers, and assist with platform notices. We do not promise a grant or a successful invalidation.

  • Opposition, invalidation, or non-use cancellation ground structure and evidence lists
  • Watch leads plus platform or counterparty notice letters

Hypothetical: An EU brand’s Chinese transliteration was filed by a stranger

Scenario & challenge:Story setup: An EU outdoor brand preparing China e-commerce finds its Chinese transliteration filed in core classes by an unrelated individual, late in the publication window. It holds EU registrations and use, but almost no China sales record. Marketing wants to call it bad faith in public; legal counsel worries about absolute language. The brand also has not decided whether to file its own Chinese name. The clock is running — miss opposition, and later paths get heavier. Possible approach:Illustrative moves: lock filing/publication dates; assemble foreign reputation and prior-use packs; analyse classes and similar goods; structure opposition/invalidation grounds from public indicators; plan the brand’s own Chinese filing in parallel. Public wording stays procedural — no “will be invalidated” claim.

FAQ

Questions, answered

General information to help you prepare for a conversation. Individual advice depends on the facts.

Why file trademarks in China early?

China weighs first-to-file heavily. Foreign use or registration does not automatically give you a China registration. Searching and filing before market entry or OEM can reduce squatting risk. Each case differs; we do not promise outcomes.

Do you guarantee we get our money back or win?

No. We explain options, main risks, and how fees are structured. Formal work is accepted and billed only through the firm.

What should I send in the first message?

Include: your company and location, the China party’s Chinese name if known, dispute type, amounts paid, contract/PO highlights, and the result you want. Contract PDFs, payment slips, chat exports, and trademark screenshots help. You may redact first; ask if you need an NDA before sharing more.

Can a foreign company hire Chinese counsel for a supplier who will not ship?

Yes. A PRC law firm can handle China-side demand letters, talks, mediation, arbitration, or court work. Which path fits depends on your contract, your evidence, and where the other side sits. Send a short case summary first. Site text is not legal advice; a form submit is not an engagement.
