OUR SERVICES

Chinese supplier not shipping, shipped the wrong goods, or holding your deposit?

Typical matters: late or no delivery, off-sample goods, short shipment, tooling disputes, silence after payment, or a payee that does not match the contracting company. We build a chronology of contracts, payments, and chats; check public registry entities; send bilingual demand letters; and map negotiation, mediation, arbitration, or court under your clause.

Container ship and port cranes (display illustration placeholder)

Deposit or advance paid, yet the other side keeps promising “we load next week” without a verifiable bill of lading or packing list — chasing only in chat is rarely enough.

Goods land far off the sealed sample or spec, and they claim the objection window closed — lock inspection proof and issue written notice promptly.

We build chronologies and entity checks, send bilingual demand letters, and map negotiation, arbitration, or court. Outcomes turn on evidence, solvency, and forum. We do not promise recovery percentages or wins.

01

When this may be relevant

  • You paid, but goods never shipped — or only part shipped
  • Arrival diverges from sample, spec, or agreed use
  • They admit a problem yet stall on refund or replacement
  • Contracting company, payee account, and factory look mismatched

02

How we may assist

  • Line up contracts, POs, payment proofs, and chat/email chronologies
  • Check registry codes and public status — identify the contracting entity
  • Draft and send bilingual demand letters with a cure deadline
  • Assess whether an asset-preservation application is worth pursuing (facts and forum permitting)
  • Map mediation, arbitration, or court under your clause, with fee shape in plain words
  • Coordinate China-side service, translation, and procedural updates when needed

Hypothetical: EU importer paid a large deposit — factory never loaded the container

Scenario & challenge:Story setup (not a real client): An EU home-goods importer signed POs by email with a trading company and paid a large advance. For three months the other side kept saying on WeChat and email that a container was “booked this week” and the B/L was “coming,” but never produced a verifiable vessel voyage or packing list. The buyer’s warehouse sat empty; retail dates were fixed. Worse: the payee name on the bank slips did not fully match the contract header, and chats sometimes named a different factory short-form. Internally the team split — keep waiting, or instruct counsel to terminate and demand repayment. Evidence lived in Outlook, WeChat exports, and bank PDFs; nobody had one chronology. Possible approach:Counsel’s first five moves (illustrative path, not a promised result): (1) one table of every payment, every “we load this week” promise, every delay; (2) public-registry check of the contract entity’s code and status against the payee account; (3) read whether the payment is a deposit or ordinary advance under the contract text, and write the termination/refund bases; (4) bilingual demand letter with a cure deadline and proof of electronic service; (5) map the forum clause — keep talking, mediate, or prepare a filing — and note that without a real B/L and packing list, “goods are on the way” is not performance. Evidence first, then letters, then filing decisions.

Hypothetical: US importer’s goods miss the sealed sample — factory says the objection window closed

Scenario & challenge:Story setup: A US importer ordered accessories against a sealed sample. Port sampling showed size tolerance and silkscreen batches off-sample. The contract had a short inspection/objection window; most chat was on WeChat; some stock was already moving to retailers. The factory replied that the objection period had lapsed — no return, no replace. In a few days the buyer had to decide: does further distribution hurt mitigation, how to word notice against the clause, who runs the lab report, and whether to keep forum options ready while talking. Possible approach:Illustrative moves: formal notice mapped to inspection/objection clauses; preserve sample-vs-shipment photos/video and sampling method; timeline payments and delivery; weigh mitigation if goods keep selling; keep repair, replacement, price cut, or termination theories ready while negotiating. Do not sign full-and-final language before evidence is locked.

FAQ

Questions, answered

General information to help you prepare for a conversation. Individual advice depends on the facts.

Can a foreign company hire Chinese counsel for a supplier who will not ship?

Yes. A PRC law firm can handle China-side demand letters, talks, mediation, arbitration, or court work. Which path fits depends on your contract, your evidence, and where the other side sits. Send a short case summary first. Site text is not legal advice; a form submit is not an engagement.

Do you guarantee we get our money back or win?

No. We explain options, main risks, and how fees are structured. Formal work is accepted and billed only through the firm.

What are the steps from first contact to engagement?

You send a case summary (or WhatsApp once the number is live) → we run a conflict check and say if we can act → firm quote and written engagement → work with updates → closing and file handover. A form alone is not an engagement.

What should I send in the first message?

Include: your company and location, the China party’s Chinese name if known, dispute type, amounts paid, contract/PO highlights, and the result you want. Contract PDFs, payment slips, chat exports, and trademark screenshots help. You may redact first; ask if you need an NDA before sharing more.
