Hypothetical: Sample passed — then bulk specs change while they push for a large advance

Illustrative port scene for advance-payment and delivery checks

This is a fictional hypothetical scenario. It does not represent an actual client, a matter handled by the firm or a result.

Hypothetical · advance-payment red flags, demand letters, preservation screen

01

Scenario & challenge

Story setup: A North American brand OEM’d consumer electronics with a “factory.” Small samples passed; chat was smooth. Before bulk, the other side suddenly changed the BOM and mould-cost split, and pushed a larger advance to a personal or affiliate account that did not match the contract header — WeChat: “pay today or lose the line.” Public filings showed a narrow business scope and a young entity; chats sometimes named another factory short-form. The buyer asks: normal commercial pressure, or time to stop and verify the entity? This story deliberately is not “case cracked, money back” — it is red flags, evidence lock, demand letters, and whether to file.

02

Possible approach

Illustrative moves: (1) red-flag table (payee vs header, unsigned spec changes, urgency scripts, entity age/scope); (2) public-registry check of code, equity, status; (3) before further payment, demand in writing: corporate account matching the contract, written spec-change confirmation, line/mould ownership notes; (4) if partial payment already left, build a chronology and bilingual letter with a cure/clarify deadline; (5) forum-clause screen for preservation options (asset hints, evidence situs) — a screen, not a freeze promise. No “case cracked” ending.

03

Limits & uncertainties

Stops when the buyer halts further advances, finishes entity checks, and sends written notices — at the fork between talks and a filing prep. No recovery sum, no criminal outcome, no “fraudsters caught.”
